RERA Registration for Real Estate Agents in India

Under the Real Estate (Regulation and Development) Act, 2016, no one may facilitate the sale or purchase of a unit in a RERA-registered project without being registered as a real estate agent with the regulatory authority of that state. The registration produces an agent number that has to be quoted in every advertisement, booking, and sale document you handle.

RERA is a central Act administered state by state, so the authority, the portal, the fee schedule, and some of the documentation differ between Tamil Nadu, Karnataka, Telangana, and every other state. Most states use a Form G-style application and grant registration for five years, renewable on a Form J-style application filed before expiry.

This guide covers who must register, the state-wise fee and validity position, the documents, the application process, what changes in how you must operate once registered, the penalty for acting unregistered, and how renewal works.

Hyderabad’s pharma and IT corridor drives frequent company incorporations and GST registrations in Hitech City / Gachibowli. We handle Telangana-specific registered office proofs and SEZ-related GST notes where relevant.

What is RERA registration for a real estate agent?

It is a licence to act as an intermediary in the regulated real estate market. Section 9 of the RERA Act requires every real estate agent to register with the Real Estate Regulatory Authority of the state where they operate before facilitating a transaction in any project that is itself registered under the Act.

The registration is issued to you or your firm, not to a project, and it carries a registration number with a defined validity period. Section 10 then imposes conduct obligations: you may not facilitate a sale in an unregistered project, you must keep books and records of the transactions you broker, and you must give buyers the information and documents they are entitled to.

The practical effect is that brokerage stopped being an informal trade. An unregistered agent cannot legally advertise or collect brokerage on a RERA project, and developers increasingly refuse to pay a commission to anyone who cannot produce a valid agent number.

Who needs RERA agent registration?

The definition of "real estate agent" is broad. It captures anyone who negotiates or acts on behalf of another person in the transfer of a plot, apartment, or building in a registered project, and who receives a fee, commission, or any other consideration for doing so.

  • Individual property brokers and channel partners
  • Brokerage firms — proprietorships, partnerships, LLPs, and companies
  • Channel-partner networks and sub-broker arrangements
  • Property portals and consultants who take a transaction-linked fee
  • Anyone marketing a registered project on behalf of a promoter
  • Agents working across states — registration is required in each state of operation

If you operate as a firm or company, register the entity rather than each employee, and make sure the entity already exists — see proprietorship registration, partnership firm registration, LLP registration, or private limited company registration.

Is RERA registration state-specific?

Yes. The Act is central but the rules, fees, and portals are made by each state government, so an agent registration granted by one authority does not let you operate in another state. Brokers working across a metro border — for example between Karnataka and Tamil Nadu — need registration with both authorities.

The fee gap between states is significant, and the gap between an individual and a non-individual applicant is larger still. Treat the figures below as an indication of how the schedules are structured rather than as a current quote — state rules are amended and a few states have also added agent training or examination requirements.

StateIndividual applicantOther than individualTypical validity
Tamil Nadu (TNRERA)Commonly ₹25,000Commonly ₹50,000Five years
Karnataka (K-RERA)Commonly ₹25,000Substantially higher — commonly in lakhsFive years
Telangana (TG-RERA)Per state schedulePer state scheduleFive years
Other states / UTsVaries widelyVaries widelyUsually five years

We confirm the exact current fee, form, and portal for your state before you pay anything, because the fee is generally non-refundable even if the application is later rejected.

What documents are required for RERA agent registration?

The core pack is identity, address, tax registration, and — for a non-individual — the constitution documents of the entity. Most authorities also want an affidavit-cum-declaration in the form prescribed by the state rules.

  • PAN card of the applicant, and of the entity where the applicant is a firm or company
  • Aadhaar or other accepted photo identity of the applicant and authorised signatory
  • Recent passport-size photographs
  • Address proof for the registered place of business in that state
  • Details of the enterprise — name, registered address, and type of entity
  • Certificate of incorporation, partnership deed, or LLP agreement, as applicable
  • Particulars of registration in any other state, and of any past registration refused or revoked
  • Income tax returns for the preceding financial years where the state rules ask for them
  • Affidavit-cum-declaration in the form prescribed by the state rules
  • Letterhead and rubber-stamp specimen where the authority requires them

Applications stall most often on the address proof for the state of operation and on a mismatch between the applicant name on PAN and on the entity documents.

How to apply for RERA agent registration?

  1. 1.Confirm the state authority and the current agent fee schedule for your applicant category
  2. 2.Set up or confirm the entity you will register — individual, firm, LLP, or company
  3. 3.Create an agent login on the state RERA portal
  4. 4.Complete the agent application (Form G in most states) with enterprise and applicant details
  5. 5.Upload identity, address, tax, and entity documents
  6. 6.Execute and upload the prescribed affidavit-cum-declaration
  7. 7.Pay the registration fee online, or by demand draft where the state still requires it
  8. 8.Respond to any query or document deficiency raised by the authority
  9. 9.Receive the registration certificate and agent registration number
  10. 10.Add the agent number to your advertising, website, and booking paperwork

Timelines vary by authority and by how complete the file is. A clean application is generally decided in a matter of weeks; a deficiency notice, an unclear entity document, or a fee paid under the wrong category can extend it considerably.

What obligations does a registered agent have?

Registration is the start of a conduct regime, not a one-off licence purchase. Section 10 and the state rules set out what you must and must not do once you hold an agent number.

  • Do not facilitate the sale or purchase of a unit in a project that is not registered under RERA
  • Quote your agent registration number in every advertisement and marketing communication
  • Maintain books of account, records, and documents for the transactions you facilitate
  • Do not make false statements, oral or written, about a project to a prospective buyer
  • Give the allottee the documents and information they are entitled to at the time of booking
  • Keep the authority informed of changes in your address, constitution, or contact details
  • Renew before expiry — an expired registration is treated as no registration

Brokerage income also carries ordinary tax compliance: GST registration once you cross the applicable threshold, GST return filing on the commission you invoice, and business ITR filing each year. Keeping brokerage records clean makes both the RERA and the tax side straightforward — see bookkeeping services.

What is the penalty for operating without RERA registration?

Section 62 provides a penalty for an agent who contravenes the registration requirement, calculated on a per-day basis up to a ceiling linked to the cost of the units involved. Continued default after an order of the authority can attract a further, heavier penalty under Section 65, and in the most serious cases imprisonment is available under the Act.

The commercial consequence usually bites first. Promoters cannot lawfully engage an unregistered agent for a registered project, so unregistered brokers lose access to primary inventory and to the commission attached to it. Buyers also check agent numbers on the authority portal before paying a booking amount.

How does RERA agent renewal work?

Registration runs for the period set by the state rules — five years in most states — and does not renew itself. The renewal application (Form J in most states) has to be filed before expiry, with the window prescribed by the state: Tamil Nadu asks for it at least a month ahead, while Karnataka asks for it substantially earlier.

Renewal fees are typically lower than the first-time fee, and updated copies of the original document set have to be submitted again. Some states allow a delayed renewal application on payment of a late fee; others treat expiry as lapse, leaving a fresh application as the only route.

Put the expiry date on the same compliance calendar as your GST and income-tax dates. Most of the agent registrations we see lapse do so because nobody owned the renewal date, not because the authority refused it.

Can a RERA agent registration be rejected, suspended, or revoked?

Yes. An application can be rejected for an incomplete or inconsistent document pack, for a fee paid in the wrong applicant category, or for non-disclosure of a registration previously refused or revoked in another state. Authorities give an opportunity to be heard before rejecting.

After grant, Section 9 allows the authority to revoke a registration for breach of the Act or the rules, for unfair trade practice, or for engaging in a transaction in an unregistered project. Revocation is published, and the agent may be barred from fresh registration for a period.

  • Incomplete affidavit or an affidavit not in the prescribed state form
  • Address proof that does not establish a place of business in that state
  • Entity documents inconsistent with the PAN or the applicant name
  • Non-disclosure of registration or refusal in another state
  • Marketing an unregistered project, or advertising without the agent number

What does a real estate agency need beyond RERA registration?

RERA registration governs how you broker; the rest of your compliance stack is the same as any service business. Which of these apply depends on your structure, turnover, and whether you employ staff.

What changes when an agency operates in more than one state?

Each state authority registers you separately, on its own form and fee schedule, and each expects a place of business it can verify in that state. A single company can hold several agent registrations, but the renewal dates and conduct rules then have to be tracked per state.

GST follows the same logic: supply of brokerage services from a place of business in another state generally means a separate GSTIN for that state, because registration under GST is PAN-plus-state. Plan the two together rather than discovering the GST consequence after the RERA registration is granted.

Frequently asked questions

Common questions about RERA registration for agents in Hyderabad.

Is RERA registration mandatory for every property broker?

It is mandatory for anyone who facilitates the sale or purchase of a unit in a RERA-registered project for a fee or commission. That covers individual brokers, channel partners, brokerage firms, and consultants taking a transaction-linked fee.

Which authority do I register with?

The Real Estate Regulatory Authority of the state where you operate — TNRERA in Tamil Nadu, K-RERA in Karnataka, TG-RERA in Telangana, and so on. Each has its own portal, form, and fee schedule.

Can one registration cover multiple states?

No. Agent registration is state-specific, so you apply separately to each authority in whose state you facilitate transactions. A firm can hold several registrations at once.

How long is a RERA agent registration valid?

Most states set validity at five years from grant, subject to the state rules. It does not renew automatically — you must apply for renewal before the expiry date.

What is Form G and Form J?

In most state rules, Form G is the agent registration application and Form J is the renewal application. The authority communicates grant, rejection, or renewal through its own corresponding forms.

How much does RERA agent registration cost?

The fee is set by the state and differs sharply between an individual and a firm or company — for instance Tamil Nadu is commonly ₹25,000 and ₹50,000 respectively, while Karnataka charges an individual a comparable amount but a non-individual substantially more. Confirm the current schedule for your state before paying, and note the fee is generally non-refundable.

Should I register as an individual or as a firm?

It depends on how you operate and on the fee gap in your state, which can be large. A firm or company gives you a brand, the ability to employ sub-brokers under one registration, and limited liability — but the non-individual fee is usually far higher.

Do my employees or sub-brokers each need their own registration?

Where the registration is held by the firm, staff acting for that firm generally operate under it. Independent sub-brokers who take their own commission are separate agents and need their own registration — confirm the position under your state rules.

Can I advertise a project before I am registered?

No. You should not market a registered project as an agent until your registration is granted, and once granted your registration number has to appear in advertisements and marketing material.

What happens if I broker a deal in an unregistered project?

That is a direct contravention of the agent obligations under the Act. It exposes you to penalty and to revocation of your registration, and promoters of registered projects will not engage an agent who has done it.
