RERA Registration for Real Estate Agents in India
Under the Real Estate (Regulation and Development) Act, 2016, no one may facilitate the sale or purchase of a unit in a RERA-registered project without being registered as a real estate agent with the regulatory authority of that state. What is RERA registration for a real estate agent?
It is a licence to act as an intermediary in the regulated real estate market. Section 9 of the RERA Act requires every real estate agent to register with the Real Estate Regulatory Authority of the state where they operate before facilitating a transaction in any project that is itself registered under the Act.
The registration is issued to you or your firm, not to a project, and it carries a registration number with a defined validity period. Section 10 then imposes conduct obligations: you may not facilitate a sale in an unregistered project, you must keep books and records of the transactions you broker, and you must give buyers the information and documents they are entitled to.
The practical effect is that brokerage stopped being an informal trade. An unregistered agent cannot legally advertise or collect brokerage on a RERA project, and developers increasingly refuse to pay a commission to anyone who cannot produce a valid agent number.
Who needs RERA agent registration?
The definition of "real estate agent" is broad. It captures anyone who negotiates or acts on behalf of another person in the transfer of a plot, apartment, or building in a registered project, and who receives a fee, commission, or any other consideration for doing so.

Is RERA registration state-specific?
Yes. The Act is central but the rules, fees, and portals are made by each state government, so an agent registration granted by one authority does not let you operate in another state. Brokers working across a metro border — for example between Karnataka and Tamil Nadu — need registration with both authorities.
The fee gap between states is significant, and the gap between an individual and a non-individual applicant is larger still. What documents are required for RERA agent registration?
The core pack is identity, address, tax registration, and — for a non-individual — the constitution documents of the entity. Most authorities also want an affidavit-cum-declaration in the form prescribed by the state rules.

What obligations does a registered agent have?
Registration is the start of a conduct regime, not a one-off licence purchase. Section 10 and the state rules set out what you must and must not do once you hold an agent number.

What is the penalty for operating without RERA registration?
Section 62 provides a penalty for an agent who contravenes the registration requirement, calculated on a per-day basis up to a ceiling linked to the cost of the units involved. Continued default after an order of the authority can attract a further, heavier penalty under Section 65, and in the most serious cases imprisonment is available under the Act.
The commercial consequence usually bites first. Promoters cannot lawfully engage an unregistered agent for a registered project, so unregistered brokers lose access to primary inventory and to the commission attached to it. Buyers also check agent numbers on the authority portal before paying a booking amount.
How does RERA agent renewal work?
Registration runs for the period set by the state rules — five years in most states — and does not renew itself. The renewal application (Form J in most states) has to be filed before expiry, with the window prescribed by the state: Tamil Nadu asks for it at least a month ahead, while Karnataka asks for it substantially earlier.
Renewal fees are typically lower than the first-time fee, and updated copies of the original document set have to be submitted again. Some states allow a delayed renewal application on payment of a late fee; others treat expiry as lapse, leaving a fresh application as the only route.
Put the expiry date on the same compliance calendar as your GST and income-tax dates. Most of the agent registrations we see lapse do so because nobody owned the renewal date, not because the authority refused it.
Can a RERA agent registration be rejected, suspended, or revoked?
Yes. An application can be rejected for an incomplete or inconsistent document pack, for a fee paid in the wrong applicant category, or for non-disclosure of a registration previously refused or revoked in another state. Authorities give an opportunity to be heard before rejecting.
After grant, Section 9 allows the authority to revoke a registration for breach of the Act or the rules, for unfair trade practice, or for engaging in a transaction in an unregistered project. Revocation is published, and the agent may be barred from fresh registration for a period.

What changes when an agency operates in more than one state?
Each state authority registers you separately, on its own form and fee schedule, and each expects a place of business it can verify in that state. A single company can hold several agent registrations, but the renewal dates and conduct rules then have to be tracked per state.
GST follows the same logic: supply of brokerage services from a place of business in another state generally means a separate GSTIN for that state, because registration under GST is PAN-plus-state.
