Legal Name Change in India — Affidavit, Newspaper and Gazette
Changing your name legally in India is a three-stage exercise, and the stages have to happen in order. You swear an affidavit recording the old name and the new one, you publish a notice in a newspaper so that anyone with an objection can see it, and you get the change notified in the Gazette. The first two are groundwork. The third is the document every bank, passport office, and department later asks to see.
The Gazette notification is what turns a private decision into a public record. For the central route the file goes to the Department of Publication and the notice appears in Part IV of the Gazette of India, which carries notices from private individuals. Some states run their own gazette route through their government press, on that state's form and at that state's fee. The Department publishes category-specific guidelines — adult, minor, surname, gender, religion, maiden surname — and the paperwork differs between them.

What is a legal name change in India?
There is no single statute in India that prescribes how an individual changes their name, and no registry that "issues" a new name. What exists instead is a settled administrative practice: you create documentary proof linking the old name to the new one, you make it public, and you then use that proof to have each of your records corrected.
The Gazette notification is the strongest of those proofs, which is why it has become the effective standard. The PAN change instructions, for example, name publication of a name change in the official gazette as the acceptable supporting document for an individual, and the passport and Aadhaar processes treat it the same way.
Note what the notification is not: it is not an order, and nobody adjudicates your entitlement to the name. The Department of Publication publishes the notice on your undertaking that the facts are true and that you accept personal responsibility for any legal consequence. That is precisely why the newspaper stage exists — it is the objection window.
Which name-change route applies to you?
The Department of Publication issues separate guidelines by category, and the required proforma, newspaper wording, and supporting documents differ between them. Picking the wrong category is a common reason a file comes back.

The last row matters if you are in central government service. Long-standing Home Ministry instructions provide for a deed of change of name executed and routed through your department, so that the service record is updated alongside the gazette notification rather than diverging from it.
How is an individual name change different from a company name change?
They share nothing except the word "name". One is an administrative publication exercise for a person; the other is a corporate action requiring shareholder approval and a fresh certificate from the Registrar.

Neither gives you rights in a brand. A name on a gazette or on the MCA register is not a trademark, and if the name is one you trade under you should look at trademark registration separately.
What are the three stages of a legal name change?

Do not reorder these. The gazette file requires the original newspaper in which the notice appeared, and the newspaper notice has to carry the same particulars as the affidavit. Publishing before the affidavit is sworn, or with different wording, is the single most common cause of rejection.
Consistency is the whole discipline here. The guidelines state plainly that the matter in the affidavit, the newspaper, the proforma, and the soft copy must be the same, failing which the file is liable to be rejected.
What must the affidavit or undertaking contain?
- Your existing name exactly as it appears on your identity documents
- The new name you are adopting, spelled and sequenced exactly as you want it recorded
- Your father's or husband's name in full
- Your full residential address
- Your date of birth and, where relevant, age confirming you are a major
- The reason for the change, stated plainly
- A declaration that you will henceforth be known by the new name
- A statement that the facts are true to the best of your knowledge and belief
- An undertaking accepting personal responsibility for any legal issue arising from the change
- Signature in your existing name, with notarisation or attestation before an oath commissioner
Decide the exact spelling and word order before you swear anything. Expanded initials, a changed middle name, a dropped surname, and a different transliteration are all separate decisions, and correcting one of them afterwards means running the whole process again.
Practice on stamp paper value and whether a notary or an oath commissioner attests varies by state, and a few states run their own affidavit formats. Confirm the local position rather than reusing a format found online — an online legal consultation is the quickest way to check.
What are the newspaper publication requirements?
The guidelines ask for the change to be advertised in a daily leading newspaper, with the notice stating your father's or husband's name, your residential address, and both the old and new names. The full original newspaper is then forwarded with the file.

The newspaper stage is the public-objection step, which is why the Department insists it comes from the individual and appears in a real daily. It is also why documents are expected to be recent — the guidelines indicate documents should not be older than about a year when submitted.
What goes into the gazette notification file?
For the central route, the file is submitted to the Controller of Publications at the Department of Publication in Civil Lines, Delhi, either in person during the stated public dealing hours or by post. The contents below reflect the standard adult category; other categories add their own documents.
- A request letter addressed to the Department
- The undertaking or affidavit duly signed by you
- The original newspaper in which the notice appeared
- Two copies of the prescribed proforma, typed on A4, signed in your existing name
- Signatures and particulars of two witnesses on the proforma
- A soft copy of the matter in editable word-processor format on the medium the Department accepts
- A certificate confirming that the hard copy and soft copy contents are identical
- Two recent passport-size photographs
- Proof of your existing name and proof of address from the Department's list of acceptable documents
- Proof of date of birth where the category requires it
- The fee receipt generated on the government payment portal
- Custody, adoption, marriage, or divorce documents where the category involves them

And fees are payable only through the official government payment portal; the Department expressly cautions against payments made on any other link or website.
Central gazette or state gazette — which one?
Part IV of the Gazette of India, which carries notices from private individuals, belongs to the central gazette. Applications for it go to the Department of Publication in Delhi regardless of where you live, and the resulting notification is a nationally recognised record.
Several states also operate their own route through the state government press or printing and stationery department, on the state's own form and fee schedule, and in some states that is the customary path. A state notification is generally accepted, but if your name will be used with central authorities — passport, PAN, central government service — the central gazette is the cleaner choice.
Publication in Part IV happens on the Department's own cycle, commonly weekly, and the published copy is downloaded from the official e-Gazette portal rather than posted to you. Download it as soon as it appears and keep several copies, because every downstream application will ask for one.

The gazette figures above are the amounts commonly cited and are indicative only; fee schedules are revised and differ between the central and state routes, so we confirm the exact amount on the official portal before you pay. How long does a name change take?
The affidavit is same-day and the newspaper notice appears within days of booking it. The gazette stage is the wait: publication commonly takes several weeks from the date the complete file reaches the Department, with figures in the range of about thirty to forty-five days widely reported. Treat that as an estimate rather than a commitment, because it depends on the Department's queue and on whether your file is complete.
Then comes the part people underestimate. Updating Aadhaar, PAN, the passport, and bank records happens in sequence, not in parallel, because each authority wants to see identity documents that already agree with each other. Budget for the whole exercise taking a few months end to end if a passport is involved.

What records must you update after the gazette notification?
Nothing updates automatically. The gazette creates the proof; each authority still needs its own application. Do them in an order that keeps your documents consistent, because most authorities cross-check against Aadhaar and PAN.

Get PAN and Aadhaar agreeing with each other first. A PAN name that does not match Aadhaar creates problems well beyond this exercise — it affects return filing and verification, so it is worth confirming the match before moving on to the passport and the bank. Do married women need a gazette notification to change their surname?
Often not, at least for tax records. The PAN change instructions treat a change of name on account of marriage differently, accepting a marriage certificate, a marriage invitation card, a passport showing the husband's name, or a gazette publication as proof. So a surname change after marriage can frequently be effected on the marriage certificate alone.
Other authorities set their own rules, and some are stricter, particularly where the change goes beyond a surname or where records already disagree. Reverting to a maiden surname has its own separate guideline at the Department of Publication, as does adopting a different surname.
The practical test is which records you actually need changed. If it is only bank and PAN records, the marriage certificate route is usually enough; if a passport, property documents, and educational records are involved, the gazette notification is the document that removes argument everywhere.
Why do name-change files get rejected?

- Documents older than the period the guidelines allow

- Identity or address proof not on the Department's list of acceptable documents
- Spelling of the new name inconsistent between the affidavit and the newspaper
These are all formatting and consistency failures rather than objections to the change itself. The Department is publishing your notice, not deciding your entitlement, so a file that matches the guideline exactly moves and one that does not simply comes back.
What does a legal name change not do?
- It does not update any document automatically — every record needs its own application
- It does not erase your former name; the link between old and new is the whole point of the record
- It does not create rights in a brand or trade name, which come from a trademark
- It does not change your PAN number, Aadhaar number, or passport number — only the name on them
- It does not discharge liabilities, contracts, or court proceedings in the old name
- It does not change a company, LLP, or firm name, which follow their own statutory processes
- It does not change your father's or husband's name recorded on documents; that is a separate correction
- It does not by itself alter records held abroad, which follow that jurisdiction's rules
